The arrival of heavier financial and custodial penalties on companies and their directors who fail to comply with laws governing the management of Occupational Road Risks mean that fleet directors and managers need to embrace a robust programme to ensure they and their drivers are compliant. Health and Safety legislation has for many years covered the vehicle as a tool of trade, but in April 2008 the latest Corporate Manslaughter legislation was brought into force, bringing with it serious additional penalties available to law enforcers when a company fails to manage these risks adequately. In the event of an accident involving a driver on company business where a fatality occurs, the investigating entity will be the Police, who will be required to assume any such fatality is an unlawful death until and unless they can conclude otherwise. The onus is squarely on the senior managers and directors of companies, partnerships and public sector entities to ensure a compliance programme is fully in place, robustly managed and constantly reviewed. There will be no opportunity to avoid culpability should an employee be the cause of the accident if such a programme is not embraced.
